ZDNet.de: „Used Software: Preo Wins Against Microsoft In Court“

Microsoft is not allowed to contradict licence transfers for formal reasons. The District Court Hamburg passed this judgement and strengthens the market for pre-owned software like that.

Remarketing is a hotly disputed topic: Again and again there is trouble between the traders for used software and the software vendors who want to stop the remarketing.

The strategy of the vendors is often based on the principle of intimidation and uncertainty. In this case, too: Microsoft utilized the revealing of all transfer details to second-guess the transfer. preo Software AG felt restricted in their business and sued, reports ZDNet.de. The judgement of the District Court Hamburg: preo wins the case, because the rejection of the transfer notifications is unfair. „With its cover letters, Microsoft ‚conveyed the impression that the transfer of the software had not occured in a proper way respectively had not taken effect’“, says the specialist magazine.

preo Software AG feels strengthened in its business. „We assume that this judgement will be the basis for a smooth process of the transfers with Microsoft“, says Boris Vöge, executive of preo Software AG.

A decision in principle for the trade with pre-owned software is expected at the end of September.
