ITespresso: „Used Software: Rout For Microsoft“

In the dispute of the remarketing of software, preo Software AG achieved victory: an injuction was granted, Microsoft is not allowed to inimidate users by sending cover letters, which second-guess licence transfers.

„The customer has the right to transfer licences to third persons. Microsoft cannot revoke this right afterwards or prohibit the transfer in general“, reports ITespresso. According to that, the cover letters sent by Microsoft are a restraint of trade for preo Software AG. Boris Vöge, executive of preo, is happy about the judgement: He thinks that this verdict will be the basis of smooth transfers with Microsoft in the future.

The information about transfer details and the revealing of the „chain of rights“ becomes a clear advantage for preo Software AG again, which is not free to be utilized obstructively by Microsoft.
