Microsoft has repeatedly written cover letters to customers, in which transfers of pre-owned software were second-guessed, reports IT-Business. Boris Vöge, executive of preo Software AG, was annoyed about this behavior: „Especially Microsoft asks permanently and loudly for transparent licence transfers. preo always reveals the whole ‚chain of rights’ and informs the software producer about the transfer details. This is increasingly utilized by Microsoft to disturb the transfer process deeply.“
preo Software AG reacted on this disturbance with a lawsuit in autumn 2009. This was granted: In the future, the software company is not allowed to send cover letters to customers which can produce insecurity.
Vöge is glad about the decision of the District Court Hamburg: „Finally a verdict which strengthens the rights of the users.“ He thinks that the judgement will be the basis for smooth licence transfers in the future.
