
The „Handelsblatt“ calls it an „endless mudslinging“: The bargain and sale of used software leads to legal disputes again and again. This time, preo Software AG is in the centre of attention, so far, preo has been characterized by transparent and secure transfer processes. preo brought an action against Microsoft, because the huge software manufacturer second-guessed licence transfers in cover letters to customers. This is, according to the District Court Hamburg, not legal.
The „Handelsblatt“ summarizes: „The court states that buyers of Microsoft software have a general right to transfer licences to third persons. Microsoft cannot revoke this right afterwards or prohibit the transfer in general.“
