Boris Vöge, executive of preo Software AG, explains the annoying conjuncture: „Especially Microsoft asks permanently and loudly for transparent licence transfers. preo always reveals the whole ‚chain of rights’ and informs the software producer about the transfer details. This is increasingly utilized by Microsoft to disturb the transfer process deeply.“
This restraint of trade leaded to a lawsuit of preo in autumn 2009 – now, the pre-owned software trader is judicially right.
With the cover letters of Microsoft, it seemed as if the transfer was not legal, reports Computerwelt. „Customers have the right to get a stipulated agreement for transfers to third parties. There is no way to prohibit these transfers in general afterwards, explains the District Court Hamburg“, tells the specialist magazine.
A judgement which strengthens the side of the users – an important step for Boris Vöge to guarantee a smooth process of the transfers.
